  • What causes this issue?

    As a result of the decision reached in Gillespie v. Northern Health and
    Social Services Board (C342/93) [1996] IRLR 214, an employer should
    recalculate an employee's SMP entitlement if a backdated pay increase
    is made effective in the period that was taken for the calculation of
    her average weekly earnings: Statutory Maternity Pay (General)
    Regulations 1986 (S.I. 1986, No. 1960) , reg. 21(7).
    This could have the effect of increasing her average weekly earnings to
    equal to or above the NICs lower earnings limit pertaining at the time
    that the earnings were originally calculated, thus making her entitled
    to a backdated payment of SMP, where she was not previously entitled.
    This re-calculation also affects the first six weeks of SMP that is
    paid at 90% of average weekly earnings.
    However, where the employee is now owed SMP, the employer only has to
    make SMP payments to her that reflect the difference between the SMP
    due and maternity allowance that would have been paid to her in the
    absence of SMP: Statutory Maternity Pay (General) Regulations 1986
    (S.I. 1986, No. 1960) , reg. 21B. If she did not receive maternity
    allowance she must obtain a letter to that effect from the Jobcentre
    Plus or Social Security Office before the employer can pay the full
    amount of SMP that is now due. Where SMP now becomes due and payable,
    or an increase in SMP is due and payable, the employer must make the
    payment. The payments are included for PAYE income tax and NICs at the
    time that they are made.
    <ZH>Maternity Allowance</>
    A woman who is not entitled to statutory maternity pay (SMP) may be
    entitled to the maternity allowance. An MA1 Maternity Allowance claim
    pack can be obtained from an antenatal clinic, Jobcentre Plus or Social
    Security Office.
    The maternity allowance is available to women whose average weekly
    earnings are at least ?30. The earliest that the allowance can be paid
    is from the beginning of the 11th week before the expected week of
    childbirth (EWC). The allowance cannot be paid for weeks during which
    the woman does some work for her employer.
    The maternity allowance is payable for up to 26 weeks and the latest it
    can start being paid is from the day following the one in which the
    baby is born. The amount of the allowance is the lower of 90% of
    average weekly earnings or ?100 a week. Therefore, if a woman has
    average weekly earnings of less than ?111.12 she will not get ?100 a
    week but a variable rate of 90% of those average weekly earnings.
    Average weekly earnings are based on any concurrent 13-week period
    chosen by the woman out of the 66 weeks before the EWC.

    If you need to reduce the employee's SMP payments during the payroll
    period, because the employee was inreceipt of Maternity Allowance, then
    manually enter adjustment wage types to reduce the amount paid in SMP
    payment wage types accordingly.
